If you read these Terms of Use (“Terms”) on www.galeries.live (” the Website”) or if you use the Galeries.live mobile application available on the App Store or Google Play (“the Application”), you agree to comply with this version of the Terms, whether you are a registered user (“User”) or just a visitor.
The Website and the App are hereinafter collectively referred to as “the Platform”.
These Terms are concluded between You and CUBE DESIGN SOFTWARE HOUSE, License No. 800079, located at AL MUTEENA 581, 1F-35, Dubai UAE (hereinafter referred to as “the Company”, “We”, “Us”, “Our”, “Galeries.live).
The Terms regulate your access to our Platform, the services we offer via the Platform, and the relationship between Users. The Users and the Company are collectively referred to as the Parties and separately as the Party.

If you do not agree with the terms of these conditions, please do not use the Platform.
1. Definitions:
Website or Application or Galeries.live – They all refer to the website www.Galeries.live or the Galeries.live mobile application;
- User – refers to any individual who, after registering on the platform, is entitled to use all the related Services, to satisfy his personal needs, which are not related to any professional activity;
- Buyer – refers to a User who wishes to purchase or has purchased one or more Items;
- Seller – refers to a User who wishes to sell or has sold one or more Items;
- Account – refers to the outcome of the User’s registration on the Site, the account created containing personal data, in particular, information relating to the use of the Services on the Website;
- Visitor – refers to any individual not registered on the Website who may use the platform without having to register, in accordance with the conditions and procedure specified in the General Terms of Use;
- Items – refers to goods/articles that are not prohibited under the applicable law and which are posted by the seller on the Platform Catalog, or on any digital content related to the Platform;
- Catalog – refers to all items offered for sale on Galeries.live;
- Shipping costs – refers to the shipping costs based on the rates of the partner delivery companies;
- Item Price – refers to the price offered by the Seller for the sale of an Item without Shipping Costs;
- Transaction Fee – refers to the price of the Item paid by the Buyer. It includes the Price of the Item, plus the Shipping Costs;
- Delivery Address – refers to the postal address to which the Item ordered by a Buyer will be delivered by the delivery agent;
- Cookie – refers to a small text file containing information stored on the device of any person who visits the Website (for example, a computer, tablet, or mobile);
- Partners – refers to those who assist in providing the Services to Users.
2. Registration on the Website
All users are required to register on the website to be able to access the content offered.
When setting up an account, the User will be required to provide accurate and complete information, including a valid email address and phone number.
The User shall regularly update his/her account to keep the information accurate and complete.
The User is fully responsible for his account, and everything related to it, including any harm or damage caused to the company, the seller, or any third party through the use of such account even without the User’s authorization.
Every account is personal and individual, the User may not transfer his account to another person or use the account of a third party. If it is proven that the account has been used in violation of these terms, the account will be closed.
Users are not allowed to share their login information with anyone. The User is solely responsible for what happens on his or her account and the company will not intervene in disputes between different account users.
The company, through its support team, may request additional information from users of suspicious accounts to verify the identity of the account user.

3. Buying on Galeries.live
Purchase process
The User chooses the item on the platform by following the instructions.
When the item is selected, he/she will be directed to a shopping cart.
Payment of the order
After selecting the items in the shopping cart, the User will be able to pay for all the chosen articles.
Payment will be made upon delivery or online.
An invoice will be sent by email to the User with the transaction details. The company will then collect the information. The storage of this information is done in accordance with the legislation in force in Tunisia for the storage, processing, and protection of personal data.
Delivery of the Article
Items will be delivered via one of the platform’s partners or by the sellers themselves.
Additional costs may be added.
- Applicable Rates are in Tunisian Dinar
- Shipping costs may vary depending on the package’s weight and size.
- The weight of a single package for a special shipment should not exceed 25 Kg in both actual weight and volumetric weight.
- For SMP shipments, the weight of a single piece should not exceed 10 kg in both actual weight and volumetric weight.
- For FIX shipments, the weight of a single piece should not exceed 7 Kg in both actual weight and volumetric weight.
- Returned or refused parcels will be sent back to the drop-off point for 24 hours. If the customer does not pick up the parcel within this period, it will be sent to the nearest Logistic Partner office to the drop-off point for 5 working days. If after that period, the customer still has not collected his parcel, it will be sent to our main warehouse for a period of 21 days. Beyond that period, we will dispose of the parcel and the customer will no longer have the right to claim his goods.
- In case of loss or theft, the customer will get a full refund of the lost goods. The customer has a period of 15 days to claim this loss as of the date of pickup. Beyond this period, any complaint will not be considered.
- The parcels should be sent with an original invoice indicating the content of the package, which must include goods in accordance with the type of activity mentioned on the patent, the legal name of the company, the tax number, and a signature with a stamp.
Return following a delivery failure
If the delivery is not successful, the package will be returned to the sender. The return of the package will incur additional costs.
4. Return and refund policy on Galeries.live platform
The buyer can request the return and the refund of the purchased product in case of a non-conforming delivery or a defective item.
He/she will have to contact the after-sales service via support@galeries.live within 24 hours from the reception of the product. They will investigate and if necessary mediate to settle the situation. If the after-sales service deems the request to be in accordance with legal and contractual regulations, they will contact the buyer to proceed with the refund and the return of the product.
5. Disclaimer of Liability
Galeries.live cannot be held responsible for the content of the Ads, nor for the actions (or lack of action) of the Users, nor for the Items offered for sale. Galeries.live cannot be held responsible for defamatory, insulting, or immoral comments posted online by a User.
Galeries.live does not intervene in any transaction between Buyers and Sellers. Consequently, it has no control over the quality of the items listed, and the accuracy of the content of the ads on the website. However, in the case of fraudulent use or inaccuracy of the information exchanged, Galeries.live has the right to take the necessary actions before the competent authorities to protect its rights and those of the platform users.
Galeries.live does not transfer ownership of the items from the Seller to the Buyer. The sale/purchase agreements are concluded directly between the Buyer and the Seller.
Galeries.live may suspend, without notice or compensation and without incurring any liability, access to the Website, temporarily or permanently. It does not guarantee that the Website will be accessible without interruption. It may suspend access to the platform for reasons notably involving maintenance and emergency purposes.
Galeries.live is not responsible for the fraudulent use by a third party and the possible consequences on the User’s login and/or password.
The contract created when the Buyer’s Purchase Offer is approved by the Seller is solely binding on the Seller and the Buyer. Galeries.live, acting as an intermediary, shall not be held responsible for any disputes declared outside of the 24-hour period following the reception of the Item by the Buyer.
6. Additional Provisions
The present General Conditions are valid as of April 7, 2022.
If one or more clauses of the present General Conditions are invalidated by a legislative or regulatory provision or by a court decision, all other clauses shall remain applicable.
By registering on the Website, the User acknowledges that he/she has read, understood, and accepted without reservation the present Terms and Conditions which regulate all relations between Galeries.live, the Sellers, and the Buyers.
This acceptance takes effect as of the user’s registration date on the Website and is valid for each operation, Ad, Purchase Offer, and Sale. The present General Conditions prevail over any contractual or non-contractual document specific to the Seller or the Buyer.
The platform, its content, catalog, texts, illustrations, photographs, and images are owned by the company. It is strictly forbidden to reproduce, represent and/or exploit all or part of the platform, its content, catalog, texts, illustrations, photographs, and images without prior authorization from the company.
7. Applicable Law and Settlement of Disputes
These Terms shall be interpreted in accordance with the laws and legislation of Dubai, without regard to its principles of conflict of laws.
Any dispute arising from the use of the platform or the services, and the formation, performance, interpretation, cancellation, termination of these terms, or arising therefrom in any way, shall be settled amicably and if necessary, through mediation. In case of failure to settle the dispute or refusal of mediation, the courts of Dubai are exclusively competent.
8. Changes to these Terms
From time to time, we may update these Terms to clarify our practices or to incorporate new or different practices (when we add new features, for example). Galeries.live reserves the right to revise or modify these Terms at any time at its sole discretion.
When we materially change these Terms, we will provide you with clear notice, including through notifications sent to the email address specified in your account or through a notice posted on our Services. Unless otherwise specified, any changes will be effective as of the date of posting.
Your continued use of our Services after the changes become effective will mean that you accept those changes. The revised version of these Terms will supersede all prior versions.
